Developer abandoned a Riviera Maya project with the underlying corporation effectively shell. Our client had paid $200,000 USD on a $400,000 contract with no unit delivered, no refund, and no developer response. PROFECO conciliation failed when developer didn't appear.

Filed civil suit for cumplimiento de contrato y daños y perjuicios. Simultaneously filed for medidas cautelares — embargo on the developer's land holdings before they could be transferred to a related entity. Asset trace identified three properties held by the principals personally.

The result

How it ended.

Default judgment plus piercing-corporate-veil ruling reached the principals' personal assets. Auction of one attached property produced $192,000 in proceeds. Recovery: 96% of paid-in capital. Process took nearly 2.5 years but recovery was substantially complete.
