Cozumel beachfront — fideicomiso restructure

Reorganized inherited fideicomiso to add second-generation beneficiaries and avoid Mexican estate tax exposure.

Duration

3 months

Outcome

Favorable settlement

The challenge

What the client was facing.

Client inherited a Cozumel beachfront fideicomiso from their father. Trust was set up in 1998 with no successor beneficiaries — a substantial Mexican ISR exposure if the client died with the trust unrestructured. Adult children were not named anywhere.

Our approach

The strategy we deployed.

Coordinated with the bank trustee to amend the trust agreement, adding two adult children as substitute beneficiaries and restructuring the succession clauses to defer ISR to second-generation transfer events. Apostilled documentation handled remotely.

The result

How it ended.

Trust amended within 90 days. Estimated ISR exposure on death event reduced from approximately $180,000 USD to approximately $20,000. Multi-generation succession path now in place.
